What is the role of the Duty Holder and Responsible Person?

The Duty Holder is the person or organisation in control of the premises and its water systems. They are legally accountable for making sure Legionella risks are assessed, controlled, and reviewed. This includes:

  • Making sure a suitable risk assessment is in place
  • Implementing a Written Scheme of Control
  • Maintaining routine water hygiene monitoring

On the other hand, the Responsible Person is an individual chosen to manage day-to-day Legionella control on the Duty Holder’s behalf. This includes:

  • Coordinating safety checks
  • Ensuring actions are completed
  • Keeping documentation up to date

 What is HSG 274 guidance?

HSG 274 is the HSE’s technical guidance that supports ACoP L8, setting out the practical control measures and monitoring expected for different water systems.

  • Part 1 focuses on systems like cooling towers and evaporative cooling systems, where fine water mist can be produced and inhaled. It notes the tighter control measures needed to reduce the higher risk of Legionella within these systems.
  • Part 2 covers hot and cold water systems found in workplaces and public buildings, as well as the practical control measures and monitoring needed for them.
  • Part 3 addresses the actions needed to manage risk systems like spa pools and humidifiers, where water is stored, recirculated, or dispersed as a fine mist.

ACoP L8 Legionella Compliance FAQs

Is ACOP L8 a legal requirement for my business?

ACoP L8 isn’t a law in itself, but it has “special legal status” as an Approved Code of Practice, and following it shows you’re meeting your duties under health and safety law (including HSWA and COSHH). If you choose a different approach, you’ll need to be able to demonstrate that it achieves an equal level of control.

How often should an ACOP L8 Legionella risk assessment be reviewed?

ACoP L8 doesn’t set a fixed review period. Instead, Legionella risk assessment should be reviewed regularly and whenever there’s reason to believe it’s no longer valid. Reasons include changes to the water system, changes in building use/occupancy, or monitoring results that suggest controls aren’t effective.

Who is the 'Duty Holder' in Legionella management?

The Duty Holder is usually the employer or the person in control of the premises and water systems (for example, a landlord, managing agent, or building operator). Under ACoP L8, they must ensure Legionella risks are assessed and controlled, and appoint a competent person to take day-to-day responsibility (known as the Responsible Person).
